1. Subject matter and scope

These General Terms and Conditions of Sale govern all relationships between the company Tinchebray Motoculture (SIREN: 903 841 989, SIRET: 903 841 989 00010, located at La Behuetterie, 61800 Tinchebray-Bocage) and any natural or legal person who makes a purchase of products via its website or by email (support@tinchebrayagrimotoculture.de).

Every order implies unconditional acceptance of these terms and conditions.

2. Products and Availability

The essential features, descriptions and technical data sheets of the products are presented on the website.

Product offers and prices are valid while stocks last. If a product is unavailable after an order has been placed, the customer will be informed as soon as possible and can request a refund or exchange.

3. Prices and invoicing

Prices are quoted in euros (€), including all taxes (VAT) or excluding taxes, as indicated on the data sheet.

The prices do not include delivery and special transport costs (especially for bulky or heavy products), which will be calculated upon ordering or quotation.

Tinchebray Motoculture reserves the right to change prices at any time; however, products will be charged based on the rates in effect at the time of order confirmation.

4. Order and Confirmation

The customer's confirmation of the order is considered acceptance of the prices, product descriptions and these terms and conditions.

A confirmation email with the order details will be sent to the customer after payment confirmation or receipt of the bank transfer request.

5. Payment terms

Payment is due immediately upon ordering. Payments can be made according to the company's accepted methods: bank transfer, credit card, check (subject to verification), or cash payment on-site in the store.

⚠️ Note: Tinchebray Motoculture reserves the right to suspend any order processing and delivery in the event of payment defaults.

6. Retention of title

The products and equipment sold remain the exclusive property of Tinchebray Motoculture until the main price and incidental costs have been paid in full and in their entirety.

7. Delivery and transport

  • Delivery areas: Deliveries are made to the address specified by the customer when placing the order.
  • Delivery times: Delivery times are only estimates. The company is not liable for delays caused by force majeure or the carrier.
  • Goods receipt: When heavy or bulky products are delivered, the customer is obliged to check the external condition of the goods in the presence of the driver and, if necessary, to note any reservations on the delivery note.

8. Statutory Warranty and Customer Service

  • Legal guarantee of conformity: Our products are subject to the legal guarantee of conformity (Articles L. 217-4 et seq. of the French Consumer Protection Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
  • Manufacturer's warranty: Some new products have a specific manufacturer's warranty, the duration and conditions of which are stated on the data sheet or in the maintenance booklet.

9. Returns and Cancellations

Consumers can return products within 30 days of receipt without giving any reason.

  • Free returns: Returns are free for the customer. Tinchebray Motoculture covers all return shipping costs and arranges collection for heavy or bulky items.
  • Refund: The purchase price will be refunded to the original payment method no later than 14 days after receipt of the cancellation notice. No fees will be charged.
  • Procedure: The customer notifies us of the return via email to support@tinchebrayagrimotoculture.de; we will send a free return label or arrange a collection date.
  • Exceptions: Only goods for which there is no statutory right of withdrawal are excluded, in particular goods made to customer specifications.

10. Liability and Force Majeure

Tinchebray Motoculture is not liable for non-performance of the contract in the event of stock shortages, force majeure, disruptions or strikes of postal and transport services, floods or fires.

11. Applicable Law and Jurisdiction

These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. If no amicable agreement can be reached, the competent French courts shall have exclusive jurisdiction to decide the dispute.
